SCOTUS Declines Risperdal Appeal, J&J to Pay $124 M

"On Monday, the US Supreme Court declined to hear Johnson and Johnson’s final appeal, forcing the company to pay $124 million for the deceptive marketing of the antipsychotic Risperdal. In 2011, South Carolina ordered the company to pay $327 million for pursuing “profits-at-all-costs” in its efforts to persuade doctors to prescribe their drug, but the fine was lowered to $136 million last year. The company had hoped to argue that the remaining penalties constituted an “excessive fine” and was supported by PhRMA, the Washington Legal Foundation, the Cato Institute and the Chamber of Commerce.

 

In September, Huffington Post and journalist Steve Brill combined to launch a 15 part series- “America’s Most Admired Lawbreaker” - about how Johnson & Johnson illegally violated FDA restrictions by pushing the antipsychotic drug, Risperdal, for use with adolescents and the elderly. The documents “revealed that the company organized special sales units illegally targeting doctors who treated the elderly and children.”

 

The company also faces about 5,400 lawsuits involving gynecomastia, following allegations that the company failed to warn doctors, patients, and regulators of the risk of abnormal breast development in young males who took Risperdal.

1987-1997 pertofran , prothiaden , Prozac 1997-2002 Zoloft 2002-2004 effexor 2004-2010 Lexapro 40mg

2010-2012Cymbalta 120mg

Sept. 2012 -decreased 90mg in 6months. Care taken over by Dr Lucire in March 2013 , decreased last 30mg at 2mg per week over 3 months. July 21 , 2013- last dose of Cymbalta

Protracted withdrawal syndrome kicked in badly Jan.2014 Unrelenting akathisia until May 2014. Voluntary hosp. admission. Cocktail of Seroquel, Ativan and mirtazapine and I was well enough to go home after 14 days. Stopped all hosp. meds in next few months.

July 2014 felt v.depressed - couldn't stop crying. Started pristiq 50mg. Felt improvement within days and continued to improve, so stayed on 50mg for 8 months.

Began taper 28 Feb. 2015. Pristiq 50mg down to 45mg. Had one month of w/d symptoms. Started CES therapy in March. No w/d symptoms down to 30mg.

October 2015 , taking 25mg Pristiq. Capsules compounded with slow-release additive.

March 2016 , 21mg

I suppose they will take it out of petty cash and it will be business as usual.

 

Allen Frances who was responsible for this should be going to jail.

 

 Frances who was responsible for putting DSM4 together and his buddies post DSM 4 publication, 1995, decide to inform Jansen pharmaceuticals that for a wee fee of $450,000 they will create practice guidelines to treat Schizophrenia specifying that atypical antipsychotic drugs are superior to earlier antipsychotics and that of the atypicals Risperdal is the drug of choice. He didnt seem too worried at the time and was happy to accept Jansens $450 000 plus an extra $65,000 for producing those guidelines quickly. Risperdal had not been approved by the FDA to treat Schizophrenia.

Then in 1996 Frances informs Jansen that he and his mates (Docherty and Kahn) consider themselves as Expert Knowledge systems and for an additional $428,000 from Jansen creates “multi arena plan” to market the guidelines !

Then in 1996 the Multi arena plan includes articles ghostwritten by Jansen that expand the use of risperdal including for ADHD, autism, bipolar disorder in children as well as a host of other indications including below average IQ. Many people then suffer from negative effects of risperdal.

In 2009 Francis repeatedly describes his work on DSM 4 as scrupulously scientific.

 

... in Dec 14 in a mad in america article Frances cites pharma for its intense and misleading marketing but strongly asserts the usefulness of antispychotic drugs in particular. The same month in a lancet psychiatry article Frances makes strong statements supporting the use of psychiatric drugs even while attacking pharma for using psychiatric diagnosis for purposes of ‘disease mongering’ .
He declares that he has no competing interests!!

None of the published articles shed light on what ssri's ... actually do or what their hazards might be. Healy 2013. 

This is so true, with anything you get on these drugs, dependance, tapering, withdrawal symptoms, side effects, just silent. And if there is something mentioned then their is a serious disconnect between what is said and reality!

And around we go business as usual.... you can't undo the harm and your can't expect pharma to give a crap when the fines are so low in comparison to the sales. 

 

J&J's antipsychotics franchise, including the Risperdal formulations and Invega, earned revenues of $3.8 billion in 2008, a decrease of 24% from 2007 to 2008.[18] Risperdal lost its patent exclusivity in March 2007, and has since seen sales decline substantially.[19]

Invega was approved in 2007 by the FDA to treat schizophrenia.[20] Invega contains a metabolite of the active ingredient of Risperdal in a controlled release formulation[21] and has been criticized as not being any different from its predecessor.[22]J&J retains exclusivity for Invega until April 27, 2010.[23]

3.8 billion in one year compared to a life time fine of 136 million.... that is a drop in the bucket. 

 

how do you write out 3.8 billion hm... I can't do the math but it is less 10%

380,000,000 - 136,000= 

the computer says 

three billion six hundred sixty-four million

 

again 3 billion number represents 1 year of sales only

 

It only sounds like a lot of money in fines to us who never see this king of money... in fact fines are calculated in as the cost of doing business like other companies factor in photo copying ink... human suffering is the missed calculation... no numbers for that. 

 

Keep in mind once read one top pharma ceo took home 40 million dollars each and every year... 

there's your proof the fines are way too low.

Was not told a thing about it being a psych med thought it was a pain killer no info about psych side effects I went nuts had hallucinations. As I had a head injury and was diagnosed with a concussion in 85 I was sent to a head injury clinic in 1990 five years after the accident. I don't think they knew I had been on prozac I did not think it a big deal and never did finish the bottle of pills. I had tests of course lots of them. Was put into a pain clinic and given amitriptyline which stopped the withdrawal but had many side effects. But I could sleep something I had not done in a very long time the pain lessened. My mother got cancer in 94 they switched my meds to Zoloft to help deal with this pressure as I was her main care giver she died in 96. I stopped zoloft in 96 had withdrawal was put on paxil went nutty quit it ct put on resperidol quit it ct had withdrawal was put on Effexor... 2years later celexa was added 20mg then increased to 40mg huge personality change went wild. Did too fast taper off Celexa 05 as I felt unwell for a long time prior... quit Effexor 150mg ct 07 found ****** 8 months into withdrawal learned some things was banned from there in 08 have kept learning since. there is really not enough room here to put my history but I have a lot of opinions about a lot of things especially any of the drugs mentioned above.
One thing I would like to add here is this tidbit ALL OPIATES INCREASE SEROTONIN it is not a huge jump to being in chronic pain to being put on an ssri/snri and opiates will affect your antidepressants and your thinking.

As I do not update much I will put my quit date Nov. 17 2007 I quit Effexor cold turkey.
