MONTREAL — The man accused of opening fire outside a Parti Québécois election celebration in 2012 told the jury at his first-degree murder trial on Monday how an anti-depressant drug changed his life.

Richard Bain claimed that he was a responsible, hard-working, caring person but his character changed after taking the anti-depressant Cymbalta in 2009.

He said he broke off a 20-year relationship with his girlfriend and began visiting strip bars every night, hiring prostitutes and quickly burning through an inheritance and savings of $900,000.

He told the court he spent a lot of money on “limousines, the best of wine, champagne, strippers.”

 

“With Cymbalta, you don’t think correctly,” he testified later. “I had all the energy in the world. Things come to my mind and I do it. You don’t think things out. It makes you not responsible.”

He said video footage of him at the shooting scene wearing a blue bathrobe and ski mask, yelling “The English are waking up,” as police led him away, was unrecognizable. “It’s totally different from my character. All my life I worked and helped other people,” he said. Asked what could explain the change, he said: “To me it was the medications.”

Bain testified that he had no memory of opening fire outside the celebrations. As the defence opened at his trial for the first-degree murder of lighting technician Denis Blanchette and the attempted murder of stagehand David Courage, Bain’s lawyer told the jury that he will ask them to find his client not criminally responsible because of a mental disorder.

Bain, 65, was the first defence witness, and he arrived on the stand carrying his personal Bible. Asked if he swore to tell the truth, he read from Matthew 5:37: “Jesus said, let your statement be ‘Yes, yes.’ ”

He described a life characterized by hard work and occasional bouts of depression that took a turn for the worse when he was prescribed Cymbalta in 2009.

As well as visiting strip bars and hiring prostitutes, he also began stockpiling food, medication, weapons and ammunition after he became convinced the H1N1 virus would lead to a global pandemic and a breakdown of civil society. He testified that he bought an army transport truck, used military fatigues, 12 CZ 858 semi-automatic rifles and 20,000 bullets for protection.

“My logic was that if you’re driving a military truck in military clothes and have firearms that look like military, no one’s going to bother you,” he testified.

On the advice of family worried about his behaviour, Bain switched to another anti-depressant, but he resumed taking Cymbalta in the spring of 2012.

On Sept. 4, 2012, provincial election day, Bain testified that he drove to Montreal to visit his sister-in-law in hospital and he became upset because she was suffering while she waited for an operation. As he was leaving at around 6:30 p.m., he asked his brother where the Metropolis concert hall was, because he heard that the PQ election-night party would be there. He said he decided to take a look out of curiosity, and he drove by it in his GMC Yukon three times before leaving. That, he told the jury, is where his memory of the day ends. He said his sister-in-law’s suffering affected him deeply.

It’s totally different from my character. All my life I worked and helped other people.

“My depression that day came over me like a wave,” he testified. He said that in addition to his regular dose of one 60 mg Cymbalta capsule taken in the morning, he downed at least eight more after leaving the hospital.

Shown video footage of his vehicle arriving behind the Metropolis shortly before midnight, of a figure leaving the vehicle and approaching the concert hall’s rear entrance and of his subsequent arrest as police pinned him to the ground, he said he had no memory of the events.

He also disputed the Crown’s portrayal of him as an angry anglophone, furious that he had been prevented from voting that day and that Pauline Marois had been elected PQ premier.

“That’s hogwash,” he said. “They won the election fair and square. We live in a democratic society.” He also said most of his friends are francophone and that he spoke French more than English around his home in the Laurentians.

The trial has heard that Bain arrived at outside the PQ celebration in his black GMC Yukon loaded with three CZ 858 Tactical semi-automatic rifles, two handguns and more than 200 rounds of ammunition. Witnesses described how he shot into a group of stagehands at the back entrance without warning. The rifle jammed after the first bullet was fired, and police managed to tackle Bain as he fled the scene.

Bain is scheduled to continue testifying Tuesday. Guttman said the defence will also include testimony from psychiatric expert Marie-Frédérique Allard and Bain’s family members and former work colleagues.

Was put into a pain clinic and given amitriptyline which stopped the withdrawal but had many side effects. But I could sleep something I had not done in a very long time the pain lessened. My mother got cancer in 94 they switched my meds to Zoloft to help deal with this pressure as I was her main care giver she died in 96. I stopped zoloft in 96 had withdrawal was put on paxil went nutty quit it ct put on resperidol quit it ct had withdrawal was put on Effexor... 2years later celexa was added 20mg then increased to 40mg huge personality change went wild. Did too fast taper off Celexa 05 as I felt unwell for a long time prior... quit Effexor 150mg ct 07 found ****** 8 months into withdrawal learned some things was banned from there in 08 have kept learning since. there is really not enough room here to put my history but I have a lot of opinions about a lot of things especially any of the drugs mentioned above.
One thing I would like to add here is this tidbit ALL OPIATES INCREASE SEROTONIN it is not a huge jump to being in chronic pain to being put on an ssri/snri and opiates will affect your antidepressants and your thinking.

As I do not update much I will put my quit date Nov. 17 2007 I quit Effexor cold turkey.

I wonder if a crowd of us who had this sort of reaction showed up at court if the judge would take it easy on the man.  Extreme personality changes are known side effects to some of us here thinking right off of the Marriages thread.

what about his Cytochrome enzymes? Do they predict this kind of thing?

 

I don't know if our testimony would help. They would think we were crazy, too, just acting sane to save our kinsman.

2009: Cancer hospital said I had adjustment disorder because I thought they were doing it wrong. Their headshrinker prescribed Effexor, and my life set on a new course. I didn't know what was ahead, like a passenger on Disneyland's Matterhorn, smiling and waving as it climbs...clink, clink, clink.

2010: Post surgical accidental Effexor discontinuation by nurses, masked by intravenous Dilaudid. (The car is balanced at the top of the track.) I get home, pop a Vicodin, and ...

Whooosh...down, down, down, down, down...goes the trajectory of my life, up goes my mood and tendency to think everything is a good idea.
2012: After the bipolar jig was up, now a walking bag of unrelated symptoms, I went crazy on Daytrana (the Ritalin skin patch by Noven), because ADHD was a perfect fit for a bag of unrelated symptoms. I was prescribed Effexor for the nervousness of it, and things got neurological. An EEG showed enough activity to warrant an epilepsy diagnosis rather than non-epileptic ("psychogenic") seizures.

:o 2013-2014: Quit everything and got worse. I probably went through DAWS: dopamine agonist withdrawal syndrome. I drank to not feel, but I felt a lot: dread, fear, regret, grief: an utter sense of total loss of everything worth breathing about, for almost two years.

I was not suicidal but I wanted to be dead, at least dead to the experience of my own brain and body.

2015: I  began to recover after adding virgin coconut oil and organic grass-fed fed butter to a cup of instant coffee in the morning.

I did it hoping for mental acuity and better memory. After ten days of that, I was much better, mood-wise. Approximately neutral.

And, I experienced drowsiness. I could sleep. Not exactly happy, I did 30 days on Wellbutrin, because it had done me no harm in the past. 

I don't have the DAWS mood or state of mind. It never feel like doing anything if it means standing up.

In fact, I don't especially like moving. I'm a brain with a beanbag body.   :unsure:

Note that he says this:

I don't know what the highest "therapeutic" dose of Cymbalta is, but he's almost definitely going to be over it with having taken nine pills in one day.  So he likely had serotonin toxicity.

I have not read anything about enzymes or any testing for that matter I think they just put him in jail and left him there a good while without any sort of "treatment" or investigation into his currant health state.  Two wks later a shrink checked him out said he was clearly psychotic at that point.

The doctor who was giving him the meds effexor and later cymbalta also accepted expensive dinners with Richard went gambling with him and took a $600 limo ride on Richards dime to go to some house Richard wanted to buy .. to "treat" the owner of the property.  It seems he was being treated by a GP for situational depression and anxiety.

As far as eating 9 cymbalta he was not sure they ere all cymbalta as he has both effexor and cymbalta in the same bottle.... really he has no memory of most of that day so who knows what he did... if he was in such a state I am not sure what he says is reliable.  His family says he changed after starting effexor and just kept getting worse.  $900 grand is a lot of money to spend.... 

 

"David Bain testified that after going on Cymbalta, his brother abruptly split up with his girlfriend of 20 years, and moved out to his cabin in the woods in La Conception, Que.

"He became very hyper, paranoid," his brother said, explaining how Bain became fixated on the H1N1 pandemic.

The court heard that Bain isolated himself in his cabin in the woods, stockpiling food and ammunition "like a hermit out in the bush."

The news made him crumble

David Bain told the court that after the 2012 shooting, he saw TV footage of a man being led away in handcuffs, yelling "The English are waking up."

But he said it never occurred to him that it could be his brother.

He didn't find out until a friend left a message on his voicemail.

"She said 'I'm sorry to hear about Richard. Whatever we can do let me know,'" David Bain told the court.

When he called her back for an explanation, and she told him his brother had been arrested for the deadly shooting, David Bain said:

"I just crumbled … My knees just gave out."

David is his brother. 
 

Philippe Laberge told the jury in the murder trial that Bain was the type of man who donated thousands of dollars to the less fortunate at Christmas.

When his wife was dying of ALS between 2011 and 2012, Laberge said Bain would drop in several times a week to check on them.

"Every time he came over to the house, his first question was — 'Do you need me to do anything for you?'" Laberge told the court.With prompting from the defence, the witness also told the court that Bain stockpiled during the time of the H1N1 flu pandemic.

He said Bain asked him to help create an inventory of everything stored in his basement, including enough food, water and vitamins to survive for at least six months.

Bain had also stockpiled semi-automatic weapons and ammunition.

Before the end of Laberge's cross-examination, the defence asked the witness to watch some footage from the night of the shooting.

In it, Bain is seen wearing a blue bathrobe as he's led away from the crime scene by police. He shouts "The English are waking up!"

Laberge told the court, "this is not the man I knew."

There are many cases of people trying to self medicate once on an AD they do booze other drugs ect it is actually common if your already manic logical thinking leaves the building... as we both well know.

Defence lawyer Alan Guttman asked for the minimum 10 years, pointing to evidence in the trial concerning Bain’s mental health. Guttman told Cournoyer the only case comparable to his client’s was that of Denis Lortie, a man with mental health problems who went on a shooting rampage in the National Assembly in 1984, killing three people and injuring 13. Lortie pleaded guilty to second-degree murder and was ordered to serve the 10-year minimum before he became eligible for parole. 


Cournoyer countered that Lortie’s sentence was based on a joint recommendation and therefore there is no explanation as to how the amount of time was determined. 


Cournoyer said he would deliver his decision on Nov. 18. Before the hearing adjourned, he asked Bain if he had anything to say. Bain looked towards several people in the courtroom who had been standing near Blanchette and Courage when they were shot. 


Still waiting if it was a drug induced psychotic episode it doesn't matter he has lost at the least ten years of his life.. the man they are comparing him to was a van doo Canadian special forces most likely given the psychotic causing anti malaria drug.....
